$HALO Inside Edge’s Todd Gordon: Halozyme Therapeutics are beating estimates; raised full-year guidance

Quiet under the highs is what I want to see. $HALO closed Monday at 111.08, about 5% under its September high of 116.85, on volume about 30% below normal. Sales jumped 48% last quarter and they raised the full-year outlook. Clear 116.85 on strong volume and I'm interested.

$HALO part 2 of 2: Merck is not dumb. They know they will ultimately lose in US as well. The attached US pending patent (newer pending MDASE) is from a court document that Merck has access to. They know Halozyme is not and will not give up in US. Halozyme’s BATNA is far stronger than Merck’s. If Merck is smart, it will try to settle now while it has some temporary and technical wins in the US as opposed to waiting for a final total loss down the road. Even if the US battle takes years, once Halozyme wins, it will be able to claw back all the retrospective value of the MDASE royalties plus damages. Bottom line, the European losses hurt Merck’s strategy immediately and US future losses will hurt Merck ultimately. Fair is fair, this is what should happen when you steal IP from others.

$HALO part 1 of 2: Halozyme has been winning in European courts and Merck has had success invalidating some of MDASE patents in the US. The problem for Merck is that the European ban hurts its Keytruda patent lifecycle strategy immediately whereas the MDASE invalidations in US don’t immediately hurt Halozyme. Even if Merck wins all the rest of PGR’s and the 3 IPR’s, Halozyme has a robust back up plan. If you read the final written decisions for the PGR’s won by Merck, you will see that Merck won the invalidation not on the grounds of prior art or obviousness but on the technical ground of broad scope and inadequate written description/enablement. The good news is that Halozyme is and has been applying for newer MDASE patents with narrower scope and better enablement (see attached for the pending patent numbers). These newer patents (if granted) have priority dates going back to early 2010’a and will still catch Merck infringing.

$HALO Not that this has anything to do with the stock price but only 5000 eyes on this ticker. Still under the radar in my eyes even after the run it's having. Seems like there's been more mentions and coverage than in the past so may help push the price up but will probably have even greater swings.

$HALO is through 116.85. Closed at 121.51 today, up 9.8% from this post on Tuesday. It sat quiet under its September high first. Volume was only average, so now it has to hold above that level.

$HALO TD Cowen lifted its target to 130 dollars from 105, Buy kept, the second firm at 130 in a week after H.C. Wainwright. JPMorgan is still at 78 with a Neutral, so the spread between the bull and neutral cases is 52 dollars. The argument sits underneath, in court. On Oct 7 a Dutch patent court in The Hague found Merck infringed Halozyme's MDASE patent and blocked Keytruda SC manufacture and sale in eight European countries, rejecting Merck's invalidity case. Halozyme was clear those MDASE patents are separate from the ENHANZE patents behind its royalty licensing, so the existing royalty stream isn't the thing at risk here. The US suit in New Jersey is still pending. Shares hit a new 52-week high at 119.21 dollars today.

H.C. Wainwright reiterated $HALO Buy-$130 and said -- Switching Takeda's primary immunodeficiency patients from GAMMAGARD LIQUID or CUVITRU to TAK-881 could add Halozyme royalties. $TAK $RHHBY JNJ ARGX LLY ORKA BMY PFE VRTX GSK ABBV GMAB CHGCY ABOS SKYE TEVA H.C. Wainwright added — On October 14, Takeda (TAK; not rated) presented detailed Phase 2/3 IgGNITE results for its investigational 20% subcutaneous immunoglobulin (SCIG) with Halozyme's recombinant human hyaluronidase (ENHANZE) in primary immunodeficiency (PID). Median single-site infusions took 75.8 vs. 132 minutes with HYQVIA, a 42.6% reduction; two-site infusions took 58.3 vs. 86 minutes, a 32.2% reduction. The same IgG dose required half the volume, with dosing every three to four weeks. We think these gains could retain HYQVIA patients and attract patients from Takeda's own non-ENHANZE GAMMAGARD LIQUID and CUVITRU, expanding Halozyme's royalty base even with flat Takeda immunoglobulin sales.

Halozyme Therapeutics said a Dutch patent court ruled in its favor against Merck, ordering the drugmaker to stop manufacturing and selling injectable Keytruda in eight European markets: Belgium, Denmark, France, Ireland, Italy, Sweden, Switzerland and the Netherlands. The Hague patent court found that Merck infringed a Halozyme patent covering MDASE, the company’s technology for rapid, high-volume subcutaneous drug delivery. The ruling could pressure Merck’s strategy for Keytruda SC, its subcutaneous formulation designed to support growth as patents protecting the original intravenous version approach expiration later this decade. Merck said it strongly disagrees with the Dutch court’s cross-border injunction, arguing that Halozyme’s patent is invalid globally and that the infringement claim has no merit. The company said it is evaluating its options. $HALO $MRK
