$CRDF New Joint Filing Both sides filed a joint motion tonight asking the court to slow down CRDF's motion to dismiss NMS’s amended counterclaims. They cite the ENEs, the August status conference, and the September 11 follow-up, and they say they need time to “finalize” those discussions. They did not pause NMS’s already-briefed motion to dismiss two of Cardiff’s extra-contractual counts. They did reserved every claim and defense, so this is not a walk-away but they very much appear to be working toward a full settlement. Bottom line: Lawyers do not jointly stop briefing unless a deal is live enough that writing the next brief feels like wasted money. Still not a signed settlement but another very encouraging signal.

But currently, at this point in time, the company is basically valued sub $100M for a beautifully packaged p3 study with AA attached, satisfying both FDA and EU authorities for approval in 1L mCRC ras mut, one of the largest indications in oncology. Whatever the settlement is, at best for NMS, it prolongs their royalty stream to 2043. Or it gives them some sort of ex US (China?) rights to Onvan. Whatever it is, it is not going to be the whole nine yards. Point is: this is DIRT CHEAP by any way you want to measure it. Hard to put a price tag, but it ain't $78M.
