$HRTX Someone should knock on the gates of the Bryson Palazzo to see if he is still kickin. No decision yet on the emergency stay order. Tomorrow is the deadline for Heron to file their opening brief for the appeal. Given Bryson's MIA status, they will almost assuredly file the operning brief along with escalating the emergency stay order to the appellate court under the defacto denial/constructive delay clause. From there, it's technically ~25 days before the final ruling on the emergency stay, whatever it might be, goes into effect. This is all just horribly painful.

$HRTX We talked about how Kevin Tang added a ton of HRTX to his holdings earlier this year, to bring his share total to 6,250,000 , and enough folks know some of his history, with Concentra being his vehicle for buyouts. But, what hasn't been discussed here is that Kevin Tang has a long history with Heron Therapeutics, one that goes far beyond just an ordinary, or even extraordinarily close, association. Kevin Tang actually co-founded Heron Therapeutics, Inc. in 2009, served as Director from 2009 to 2012, and Chairman from 2012 to 2020, so it would not come as a surprise to find that Tang's radar is locked onto Heron Therapeutics, and for those who aren't familiar with how Kevin Tang operates, you can simply research his history and that of his Concentra operation Chew on this for a while, after researching Kevin Tang's tactics and M&A history.. . . .

$HRTX September OpEx is two weeks from now, and there's the matter of that mammoth options Strangle that was put in place many months ago, and options strangles are only done with the expectation of a major event moving the stock by a hell of a lot, because that sorta bet doesn't work on anything small, so the one(s) who placed it would only have done so with knowledge that is unavailable to the general public, and the fuel for the move could very well be the tremendous and utterly unfathomable 50M heap of short interest...... KABOOM!!!! . . .

$HRTX To the short sellers: it’s pointless spreading fear-mongering news here without any data to back it up. Institutions have already locked up 80.55% of Heron shares—not to mention the holdings of insiders who never sell—so the very limited free float won't be enough for you to cover your borrowed positions. You’d be better off preparing for the 43–50 million shares you owe and need to return. Hahahaha.

$HRTX should have bought XBI when I bought Heron 7 years ago. It's up about 30% in 7 years. Heron seems to be the only bio not preforming.

$HRTX Ok so after some research they only thing that happens is Heron filing their opening brief, its something. That said, the next thing that actually moves the case is Azurity’s response brief, roughly mid-October if Heron files on time and there is no extension. A decision from the Federal Circuit is still months away. Cheers

$HRTX Heron is in a world of financial hurt. They had to stop the hiring of the additional sales reps That will keep a lid on Zyn and Apo sales growth. Only way Heron comes out of this as a company is for them to sell Cin for $150M or greater…. Pay of Hercules Have some extra cash in the bank to hire additional sales reps And Maybe Collard and team will cut their pay to help this company get more lean But so far he is just been greedy. This is all on him. Sorry But he should have hired more sales reps in addition to the CL reps. He thought he could get the milk for free Zyn is not an easy drug to sell. Collard screwed this up.

$HRTX If you read the 10-Q, Heron talks about their “working capital facility agreements” and “minimum cash covenant, minimum revenue covenant and a minimum EBITDA covenant”. I believe this is all Hercules. And they want their money And Heron may not be able to pay them back even if they get an “emergency stay”. Heron needs to pay sell Cin and pay off Hercules debt. Collard needs to cut from the top and not the bottom. This is a Fing nightmare.

$HRTX People expecting a stay on the cinvanti ruling should not hold their breath. I just did some research and heron has not even filed a motion for a stay. Until they file a motion, obviously nothing will happen. It is very unlikely they will get a stay even if they file a motion. Maybe they have other plans that might be better for heron and its shareholders. Lets hope for a better strategy.

$HRTX why hasn’t CC pursued a European or rest of world license deal for Zyn or Apo? seems like they could get some upfront money from such a deal and bury the liquidity issue
